End User License Agreement (EULA)

1. Acceptance of EULA

By accessing or using LendMatcher's platform, software, and services, you agree to be bound by this End User License Agreement (EULA). If you do not agree to these terms, please do not use our services.

2. License Grant

2.1 Software License

Subject to your compliance with this EULA, LendMatcher grants you a limited, non-exclusive, non-transferable, revocable license to access and use our platform, software, and services for your personal or business use in accordance with these terms.

3. License Restrictions

  • Distribute, sublicense, or transfer your license to any third party

4. Content Monitoring and Moderation

LendMatcher employs advanced automated systems to monitor and analyze all content uploaded, shared, or transmitted through our platform. This includes but is not limited to:

  • Text analysis for inappropriate language, threats, or harmful content
  • Image and document scanning for prohibited materials
  • Behavioral pattern analysis to detect spam, fraud, or abuse
  • Real-time monitoring of user interactions and communications
  • Automated flagging of suspicious activities or content

4.2 Human Moderation

In addition to automated systems, our dedicated moderation team reviews flagged content and investigates reported violations. Moderators have the authority to:

  • Remove content that violates our policies
  • Suspend or terminate accounts for serious violations
  • Escalate cases to law enforcement when necessary

5. Prohibited Content and Activities

5.1 Zero-Tolerance Policy

LendMatcher maintains a strict zero-tolerance policy for harmful, violent, or inappropriate content. Users are strictly prohibited from posting, sharing, or distributing any content that:

  • Contains violent content, graphic imagery, or promotes physical harm to individuals or groups
  • Promotes hate speech, discrimination, or harassment based on race, ethnicity, religion, gender, sexual orientation, disability, or any other protected characteristic
  • Contains threats of violence, intimidation, or coercion
  • Promotes terrorism, extremism, or illegal activities
  • Contains sexually explicit content, pornography, or adult material
  • Infringes on intellectual property rights or violates privacy laws

  • Promotes self-harm, suicide, or dangerous activities
  • Contains malware, viruses, or other harmful code

5.2 Spam and Abuse Prevention

Users are prohibited from engaging in spam or abusive behavior, including:

  • Sending unsolicited messages or communications
  • Creating multiple accounts for the purpose of circumventing restrictions
  • Using automated systems to send messages or interact with other users
  • Manipulating platform metrics or engagement through artificial means
  • Harassing, stalking, or repeatedly contacting other users without consent
  • Impersonating other users, companies, or LendMatcher staff
  • Attempting to manipulate or game the platform's matching algorithms

6. Enforcement and Consequences

6.1 Immediate Actions

Violation of our content policy will result in immediate action, including but not limited to:

  • Immediate removal of the violating content
  • Temporary suspension of your account (7-30 days for first violations)
  • Permanent account termination for repeated violations or severe infractions
  • Reporting to relevant authorities for illegal content
  • Legal action if necessary to protect our platform and users
  • Notification to law enforcement for criminal activities
  • Cooperation with legal investigations and proceedings

6.2 Escalation Process

Our enforcement process follows a progressive escalation model:

  • Warning: First-time minor violations receive a warning with educational content
  • Temporary Suspension: Repeated violations result in 7-30 day account suspension
  • Extended Suspension: Serious violations may result in 30-90 day suspensions
  • Permanent Ban: Severe violations or repeated serious infractions result in permanent account termination
  • Legal Action: Criminal activities are immediately reported to law enforcement

7. Content Moderation Rights

LendMatcher reserves the right to review, moderate, and remove any content that violates these policies. We may use automated systems and human moderators to identify and address policy violations. Users are encouraged to report inappropriate content through our reporting mechanisms.

7.1 Moderation Discretion

Our moderation team has full discretion to:

  • Interpret and apply our content policies
  • Make decisions based on context and intent
  • Consider cultural and regional differences in content assessment
  • Take action against content that may not explicitly violate policies but is harmful to the community
  • Implement temporary measures to address emerging threats or abuse patterns

8. Appeal Process

9. Software Updates and Maintenance

LendMatcher may perform scheduled maintenance that may temporarily affect platform availability. We will provide advance notice of planned maintenance when possible.

9.3 Third-Party Software

Our platform may include third-party software components. Use of such components is subject to their respective licenses, which are available upon request.

10. Data Collection and Privacy

Our content monitoring and moderation activities may involve the collection and analysis of your content and usage data. This is done in accordance with our Privacy Policy and is necessary for:

  • Ensuring platform safety and compliance
  • Detecting and preventing abuse and violations
  • Improving our moderation systems and policies
  • Providing support and resolving disputes
  • Complying with legal obligations

11. Termination

11.1 Termination by You

You may terminate your account and this license at any time by contacting us or using the account deletion feature in your settings.

11.2 Termination by Us

We reserve the right to suspend or terminate your account and this license for violation of this EULA or for any conduct we deem harmful to the platform or other users.

11.3 Effect of Termination

Upon termination, your license to use the platform ceases immediately. We may delete your account data in accordance with our Privacy Policy.

12. Disclaimers and Limitations

The platform and software are provided "as-is" and "as-available" without warranties of any kind, either express or implied. We do not guarantee that our content monitoring systems will detect all violations or that the platform will be free from harmful content.

13. Changes to EULA

We may modify this EULA at any time. We will post updates on our site and notify users of significant changes. Continued use constitutes acceptance of the updated EULA.
